HolyJot Terms of Service
Effective Date: May 30, 2025

This Terms of Service Agreement ("Agreement") is between you ("User," "You," or "Your") and HolyJot, LLC, a Wyoming Limited Liability Company operating out of Florida ("HolyJot," "We," "Our," or "Us"). By accessing or using HolyJot's websites, mobile applications, or services ("Sites" or "Services"), You agree to be legally bound by this Agreement.

If You do not agree to these terms, do not access or use the Services.

1. Acceptance of Terms

By accessing the Services, You affirm that You are at least 18 years of age and competent to enter into a legal agreement. Your continued use of the Sites constitutes binding acceptance of this Agreement.

2. Defined Terms

• “User Content” refers to any journal entries, prompts, feedback, or media You post to the platform.
• “Faith” is our proprietary AI-powered Christian journaling assistant.
• “Confidential Information” means non-public or proprietary data disclosed under this Agreement.
• “Sensitive Data” includes medical, financial, or legally protected personal information.
• “Affiliate” refers to entities under common control with HolyJot.
• “Services” refers to all HolyJot tools, features, content, and offerings.

3. Scope of Services

HolyJot provides a free, faith-based online journaling platform and community for spiritual growth. Services include:

• AI-powered insights via Faith
• Journaling journeys, Bible study clubs, and essay writing
• Group discussions and guided media reflections
• Optional access to coaches (not therapists)

HolyJot is not a healthcare provider and does not offer clinical or medical advice. Always consult a licensed professional for health concerns.

4. User Conduct & Restrictions

You agree not to:

• Violate any local, state, federal, or international laws.
• Use the Services to transmit obscene, defamatory, or hateful content.
• Upload or request generation of content that infringes third-party intellectual property.
• Harass, stalk, impersonate, or harm another individual.
• Circumvent security or system restrictions.

5. Intellectual Property

All platform content (excluding User Content) is owned by HolyJot, including the Faith AI, trademarks, logos, and proprietary features. By submitting User Content, You grant HolyJot a worldwide, royalty-free, perpetual, non-exclusive license to use, modify, and display such content for Service delivery.

6. Third-Party Rights

Do not use HolyJot to infringe upon third-party copyrights, trademarks, privacy, publicity, or contractual rights. This includes uploading or prompting the generation of content based on:

• Copyrighted books, sermons, or media
• Logos or registered marks without permission
• Personal data of others without consent

Users are responsible for ensuring compliance with all applicable laws. Claims of IP misuse may be sent to legal@holyjot.com.

7. Account Creation and Security

You agree to maintain accurate profile information and safeguard your credentials. Notify HolyJot immediately of any unauthorized access. We reserve the right to suspend or terminate accounts for misuse or policy violations.

8. Fees and Payments

Most services are free. If paid features are introduced, You’ll be informed during signup or upgrade. Subscription fees are billed in advance and are non-refundable unless otherwise stated.

9. Data Privacy

Please review our Privacy Policy for details. By using the Services, You consent to the collection and use of personal data in accordance with the policy.

10. Termination

HolyJot may suspend or terminate Services at any time for any reason, including breach of this Agreement. We may provide notice, but are not required to do so. Users may delete their accounts at any time via their profile settings.

11. Disclaimer of Warranties

Services are provided “AS IS” and “AS AVAILABLE.” We do not guarantee uninterrupted access or error-free content. Faith AI is an exploratory, faith-based assistant and should not be interpreted as professional, medical, or legal counsel.

12. Limitation of Liability

To the fullest extent permitted by law, HolyJot’s total liability for any claim arising out of this Agreement shall not exceed:

The amount paid by You in the past 6 months, OR

Five hundred U.S. dollars ($500), whichever is greater.

We are not liable for indirect, incidental, or consequential damages.

13. Indemnification

You agree to indemnify, defend, and hold harmless HolyJot, its officers, Affiliates, and employees from and against any claims, liabilities, damages, or costs arising from:

• Your violation of this Agreement
• Your use of the Services
• Any User Content You submit
• Infringement of third-party rights

14. Hold Harmless

By using the Services, You agree to release, waive, and hold harmless HolyJot, LLC and its Representatives from any and all claims, demands, damages, and causes of action arising out of or connected with Your use of the platform, including—but not limited to—mental health, legal, or spiritual decisions made based on Service content.

15. Governing Law & Jurisdiction

This Agreement is governed by the laws of the State of Florida, with jurisdiction and venue in the courts of Lee County, Florida, or the federal courts of the Middle District of Florida. As a Wyoming-registered LLC, HolyJot also abides by applicable Wyoming corporate law. No class actions are permitted. Claims must be filed within two (2) years.

17. Modifications

HolyJot may amend this Agreement at any time. We will notify You via email or platform notice. Continued use of Services after 30 days of notification constitutes acceptance.

18. Miscellaneous

If any provision is deemed invalid, the remainder shall remain in force. Section titles are for convenience only. This Agreement contains the full understanding between You and HolyJot. You may not assign rights without our prior consent.
